Every year, fatal road traffic accidents cost thousands of lives. A report issued by the World Health Organisation warns that on current trends road traffic accidents could outstrip stroke and HIV as one of the main causes of preventable deaths by 2020.
In the UK every road user owes a duty of care to other road users not to drive their vehicle negligently. If you've been involved in a road traffic accident where another driver has breached his or her duty of care to you and that action has resulted in your suffering injuries, you may be entitled to bring a traffic accident claim against the other driver. You might be a pedestrian, a cyclist, motor cyclist or another car driver on the road.
By law all drivers must have at least third party insurance cover. This means that their insurers will pick up the bill if the driver causes an accident and injury to any other party (including any passengers, whether related to the driver or not). If you are unfortunate enough to be involved in an accident with an uninsured driver, or with a driver who doesn't stop after the accident, then your claim is likely to be covered by a special agreement covered by the Motor Insurers' Bureau an organisation set up specifically to cover such incidents.
Zara was hit in the rear while waiting at a set of lights. She broke her arm in two places, requir physiotherapy for over 12 months.
She was initially offered £1300 by the insurance company, but thought that this was not a fair reflection on the pain, suffering and loss of amenity.
Zara contacted us about her about her accident. We established that it seemed clear that the other driver was at fault. Francis Alexander explained to Zara the options available and that they could take on her case on a no win no fee basis;
“The staff at Francis Alexander were excellent. They explained the process clearly. They arranged for me to see a private doctor to get a real assessment of my injuries. It was a real weight off my mind to know that someone was acting on my behalf”
Francis Alexander wrote to the insurance company on Zara’s behalf and arranged for her to be seen by an orthopaedic specialist. Once the medical report had been received Francis Alexander sent this to Zara’s insurance company.
“I ended up with over £3,000 in compensation. They even got me money back for clothes I had damaged in the accident! I intend to use the money to fund my University Degree. I would recommend Francis Alexander to anyone; they really helped me when I needed someone on my side”
If the accident was not your fault and you have been injured then you should consider making a claim.
If the other driver is responsible for the accident and you can prove that his negligence caused your injuries, you will be able to recover compensation for the pain and suffering caused by your injuries, loss of certain enjoyments in life as a result of your injuries, for example if you are no longer able to play with your children or play sport.
You may also claim any wages you already lost and will lose in the future because of your injury; and any expenses you incurred as a result of your injury such as traveling to the doctor, medication charges, equipment you need to use as a result of your injuries, and similar future expenses and the cost or value of care you had to have and will need in the future because of your injury.
However in the unfortunate event that your case is unsuccessful, you do not pay anything towards our charges and disbursements.(subject to certain criteria)
You do not have to use the solicitors chosen for you by your insurers. They may be convenient for them, but not necessarily for you.
We believe that it is in your interest to instruct your own Solicitors who are independent of insurance companies.
At Francis Alexander, we strive to maximise your compensation, accelerate the litigation process and ensure that you retain 100% of your award.
